The FDA Just Said Menthol Vapes Are Worth the Youth Risk. That Is the Whole Smoke-Free Thesis in One Sentence.

Juul got authorization for its Juul2 device with tobacco and menthol pods. The agency found a substantial share of adult smokers switched completely, more of them with menthol, and said the benefit to adult smokers outweighs the risks, “including youth appeal.”

In one line: The regulator that once nearly banned Juul has now written down, in an authorization order, that getting adults off cigarettes is worth some teenage risk, and that is the thesis behind the tobacco names in our income sleeve.

Juul Labs got the go-ahead from the Food and Drug Administration to sell a new version of its e-cigarette, the Juul2, along with tobacco- and menthol-flavored pods. The company, which is privately held, says the device delivers a more consistent vapor and nicotine experience and is designed to compete with combustible cigarettes. That is a short business story. The sentence inside it is a long one.

What the FDA actually wrote

The agency reviewed Juul’s application and found that a substantial proportion of adult smokers completely switched from cigarettes to the authorized Juul2 products, and that the switch rate was higher for the menthol pod than for tobacco. Then it said this: “The added benefit to adults who smoke cigarettes is sufficient to outweigh the risks of the menthol-flavored product, including youth appeal.”

Read that twice. Menthol is the flavor regulators have fought hardest over, because it is the one teenagers like. The FDA has now put on paper that, for this product, moving adult smokers off cigarettes is worth that risk. Juul says it will file next for 5%-nicotine products and a range of flavors beyond tobacco and menthol.

Why we care, and it is not Juul

You cannot buy Juul; it is private. You can buy the companies whose entire strategy is the sentence above. Philip Morris International’s Zyn pouches and IQOS heated tobacco made 41% of its 2025 sales smoke-free. British American Tobacco’s Vuse and Velo took its U.S. pouch share from 6.7% to 16.2% last year. Altria, which once owned a third of Juul and now sells the NJOY vape it bought instead, is the laggard trying to catch up. All three sit as “+” rows in our dividend sleeve. The thesis is simple: the cash comes from cigarettes, the growth comes from what replaces them, and the regulator has just endorsed the replacement.

The health footnote

None of this makes vaping healthy. The FDA’s frame is harm reduction: less bad than cigarettes for adults who would otherwise smoke. For a client who smokes, that is the honest planning conversation, and it has a dollar figure attached, because life and long-term-care underwriting still treat nicotine in any form as tobacco at most carriers. Quit and the premium drops after a year or two of clean tests. Switch and it usually does not.

Hold — the tobacco sleeve, reinforced by the regulator

Hold PM, BTI and MO in the dividend sleeve: the FDA has now written the smoke-free thesis into an authorization order, and the dividends were never the part in doubt.

PM and BTI are the way to own this; Juul is private and Altria is the follower. No weight change; the order strengthens a thesis already sized.
